Domestic Student Application

OC recognises students’ right to privacy. OC collects, uses, stores, and discloses personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, as well as relevant State and Territory Legislation.

Personal information is collected for the purposes of processing applications, enrolment administration, delivering training and assessment, verifying eligibility and prior qualifications, meeting student support needs, and fulfilling OC’s obligations under the Standards for Registered Training Organisations 2025, and other relevant State, Territory, and Commonwealth laws. Information collected may include personal and contact details, visa information, academic and training records, progress reports, and other data required for enrolment and compliance with State, Territory, Commonwealth requirements.

Information collected about you may be disclosed, where required, to:

• The National Centre for Vocational Education Research (NCVER) and the Australian Government under the National VET Data Collection
• State or Territory training authorities (including Skills Victoria or other relevant bodies for funded training)
• Government departments, agencies and regulators for compliance and reporting purposes
• Your employer, where training is undertaken under an apprenticeship, traineeship, or employer-sponsored program
• Other third parties only where authorised or required by law.

The information provided in this enrolment form may be used by the Australian Government for purposes including planning, administration, policy development, program evaluation, resource allocation, and reporting and/or research activities. For these and other lawful purposes, the Department may disclose information to its consultants, advisers, other government agencies, professional bodies, and other organisations as authorised or required by law.

Where applicable and in limited circumstances, OC may verify information contained in a student’s ImmiAccount or other visa-related documentation to confirm that details submitted to immigration authorities are consistent with enrolment information. OC will only request and collect information directly necessary for enrolment and compliance purposes. By signing and accepting an offer of enrolment, students are taken to have provided consent for this collection, use, and disclosure. Students may withdraw or amend their consent in writing at any time.

OC will not disclose your personal information to unauthorized entities. All information is stored securely and managed in line with OC’s Privacy Policy. You may request access to or correction of your personal information at any time by contacting Student Services.

Students are encouraged to maintain privacy awareness when using social media and online platforms and to limit the disclosure of personal information, including contact details, location, and photographs, to trusted parties only.

The right to make of Complaints and seek Appeals of decisions and action under various processes, does not affect the rights of the student to take action under the Australian Consumer Law if the Australian Consumer Law applies.

Why we collect your personal information

As an RTO, we collect your personal information so we can process and manage your enrolment in a VET course with us.* If we do not receive your details in this form, we will not be able to proceed with your enrolment.

How we use your personal information

We use your personal information to enable us to deliver VET courses to you, and otherwise, as needed, to comply with our obligations as an RTO.

How we disclose your personal information

We are required by law (under the National Vocational Education and Training Regulator Act 2011 (Cth) (NVETR Act)) to disclose the personal information we collect about you to the National VET Data Collection kept by the NCVER. The NCVER is responsible for collecting, managing, analysing and communicating research and statistics about the Australian VET sector.

We are also authorised by law (under the NVETR Act) to disclose your personal information to the relevant state or territory training authority.

How the NCVER and other bodies handle your personal information

The NCVER will collect, hold, use and disclose your personal information in accordance with the law, including the Privacy Act 1988 (Cth) (Privacy Act) and the NVETR Act. Your personal information may be used and disclosed by NCVER for purposes that include populating authenticated VET transcripts; administration of VET; facilitation of statistics and research relating to education, including surveys and data linkage; and understanding the VET market.

The NCVER is authorised to disclose information to the Australian Government Department of Education, Commonwealth authorities, State and Territory authorities (other than registered training organisations) that deal with matters relating to VET and VET regulators for the purposes of those bodies, including to enable:

• administration of VET, including program administration, regulation, monitoring and evaluation
• facilitation of statistics and research relating to education, including surveys and data linkage
• understanding how the VET market operates, for policy, workforce planning and consumer information.

The NCVER may also disclose personal information to persons engaged by NCVER to conduct research on NCVER’s behalf.

The NCVER does not intend to disclose your personal information to any overseas recipients.

Surveys

Students may be contacted by NCVER or a Department-endorsed contractor to participate in surveys, audits, reviews, or evaluation projects related to vocational education and training in Australia. Participation in such activities is voluntary, and any information collected will be handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

By signing the attached ‘Enrolment Form’ and sending/forwarding that form to OIC, the Student has agreed with OIC to comply with these terms and conditions. These terms supersede and prevail over any other terms and conditions included in any purchase order, conformation, or other document or communication from the Student to OIC.

• Enrolment: On receipt of the Enrolment Form, OIC may, in its sole discretion, either enrol the Student in one or more of the Training Qualifications, or decline to enrol the Student in one or more of the Training Qualifications. If OIC enrols a Student in a Training Qualification, it will notify the Student in writing of such enrolment (such notice will specify the date, time and location of the Training Qualification).
• Cancellations: If the Student is enrolled in Training Qualification, they may cancel that enrolment by notifying OIC in the manner set out in the Deferral, Suspension and Cancellation Policy prior to the start of Training Qualification.
• Qualification fees: The fees for enrolling in a Training Qualification are set out in the Fees and Charges form. OIC may, from time to time, vary the fees by publishing those prices within its new Enrolment Forms.
• Scholarships and Discounts: Scholarships or tuition fee discounts offered by Orange College (OC) are conditional and subject to the student maintaining satisfactory academic progress, attendance, and compliance with all enrolment conditions throughout the duration of their course. If a student fails to meet the required progress, attendance, or conduct standards, or breaches any condition attached to the scholarship or discount, the concession will be revoked, and the student will be liable to pay the full standard tuition fees applicable to their course from that point forward. OC reserves the right to review and adjust any scholarship or discount arrangements in accordance with this policy and relevant institutional guidelines. • Payment of fees: The fees must be paid by either the Student or the Employer as applicable at the time the Enrolment Form is submitted to OIC. The Student acknowledge that OIC will not enroll the Student until the fees are paid as per the payment schedule or dates provided.
• Qualification rescheduling: OIC may cancel, postpone, reschedule or relocate any Training Qualification due to low enrolments or other unforeseen or unexpected circumstances. If OIC exercises this option, OIC will use its reasonable endeavours to notify Students of any such chance to a Training Qualification as early as practicable in the circumstances.
• Intellectual Property Rights: Any intellectual property rights subsisting in the Training Materials are owned by OIC and, where appropriate, its licensors. The Student must not reproduce, modify, enhance, adapt, translate, publish, perform, communicate or create any derivative work based on the whole or nay part of the Training Materials. The Student must not remove, deface or obscure any identification, trademarks, proprietary or copyright notice on any part of the Training Materials. No intellectual property rights are assigned or licensed by OIC to the Student under these Terms and Conditions. The Student must not take any action, or cause any third party to take any action, contesting the ownership rights set out in this clause and must do all things necessary or convenient to give effect to this clause.
• Use of Training Materials: The Student may use the Training Materials solely for undertaking the Training Qualification to which the Training Materials relate. The Student must not distribute, disclose, sublicense, rent, lease, or sell or otherwise grant transfer any interest in the whole or any part of the Training Materials to any person, except with the prior written consent of OIC.
• Visa Status Changes: Students who are on temporary visas with study rights (other than Subclass 500 student visa holders), such as Subclass 485 (Temporary Graduate), Subclass 600 (Visitor with study condition), or Humanitarian visas, must notify OC immediately if their visa or residency status changes.
• Transition to International Enrolment: Students who fall into the above category but choose to be enrolled under a Confirmation of Enrolment (CoE) will be managed under the international admissions process, in line with the requirements of the Education Services for Overseas Students (ESOS) Act and the National Code.
• Special Enrolment Conditions for Temporary Visa Holders: Students on temporary visas with study rights who are enrolled as domestic fee-for-service must meet OC’s entry requirements, including English language proficiency and academic requirements, which are equivalent to those applied to international students unless specified.
• Student Obligations:
  • Comply with its obligations in the Training Plan;
  • Follow the Training Plan and make all reasonable efforts to ensure that units are completed by the dates specified in the Training Plan;
  • Ensure the supervisor of progress in relation to the apprenticeship/traineeship;
  • Ensure that the supervisor signs any sign-offs and reports required;
  • Comply with the National Code of Good practice for Australian Apprenticeships (where applicable) and relevant Australian Government and State/Territory laws (including, without limitation, those that relate to occupational health and safety, discrimination and Australian apprenticeship/traineeship arrangements).
• Exclusion of Liability: To the extent permitted by law and except any implied term, condition or warranty the exclusion of which would contravene any statute or cause any part of these Terms and Conditions to be void (‘Non-excludable Condition’), OIC and its related bodies corporate disclaim and exclude all terms, conditions and warranties implied by custom, the general law or statute.
• Several Liability: An agreement, representation or warranty on the part of two or more persons binds them separately.
• Governing Law: These Terms and Conditions are governed by the laws in force in the state where the training is undertaken in Australia. The parties irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of that State/Territory and any courts which have jurisdiction to hear appeals from any of those courts and waives any right to object any proceedings being brought in those courts. These Terms and Conditions constitute the entire agreement between the parties relating to the subject matter of these Terms and Conditions and may only be varied by the written agreement of the parties.

Fees and charges for traineeship / apprenticeship programs are based on prices set by State/Territory Training Authorities. Fee-for-service qualification prices are set after consultation between state branches and the national secretariat. Students who hold appropriate health care or concession cards may be granted concessions on tuition or administration fees.

In signing or emailing this form I acknowledge and declare that:

• I have read and understood and consent to the privacy notice and have completed all questions and details on the enrolment and eligibility forms
• The information herein provided is true, correct and complete to the best of my knowledge at the time of my enrolment.
• I am eligible to study in Australia as either an Australian citizen, or a resident on a visa that allows me to study with a provider who is NOT CRICOS approved. For more information on visas and studying in Australia, visit Home Affair’s website.
• I acknowledge that OC may collect and use personal information, including visa or residency information where applicable, for the purpose of verifying eligibility and meeting compliance obligations under the NVETR Act and other applicable laws. In limited circumstances, this may include reviewing documents lodged within my ImmiAccount to verify that supporting documents submitted to the Department of Home Affairs are consistent with my enrolment application. In all such cases, OC will obtain my express written consent prior to accessing this information.
• Where applicable, I agree to notify OC immediately if my visa or residency status changes.
• I understand that if I require a Confirmation of Enrolment (CoE), my enrolment will be managed under the international student admissions process in accordance with the ESOS Act and the National Code.
• I understand that, where applicable, if I am enrolled as a domestic fee-for-service student on a temporary visa with study rights, I must meet OC’s English language proficiency and academic requirements.
• I confirm that arrangements have been made to pay the fees and charges for this qualification (either by myself or my employer) as per the payment schedule/plan provided, and I understand that my enrolment is conditional upon payment.
• I have read and understood the Scholarship Policy and I understand that any scholarship or tuition fee discount granted by OC is conditional upon my maintaining satisfactory academic progress, attendance, and compliance with all enrolment requirements. I acknowledge that if I fail to meet these conditions, or if my enrolment or progress is breached, the scholarship or discount will be withdrawn, and the standard tuition fees for my course will apply
• I have read and understood the Student Handbook
• My participation in this course is subject to the right to cancel or amalgamate courses or classes. I agree to abide by the rules and regulations of OC.
• I confirm that I have been informed about the training, assessment and support services to be provided and about my rights and obligations as a student at OC.
• I authorise OC or its agent, in the event of illness or accident during any OC activity, and where emergency contact or next of kin cannot be contacted within reasonable time, to seek ambulance, medical or surgical treatment at my cost.
• I have access to the internet and a printer, complying with OIC’s policies
• Where applicable, I agree to comply with the traineeship/apprenticeship terms and conditions provided in the Student Handbook.
• I agree to comply with all the Terms and Conditions included in this Enrolment Form.
• I consent to Orange College using and publishing my name, and any photographs or videos in any of its publications and materials (including written, electronic or multimedia materials) for distribution anywhere in the world, on OC website and social media platforms, for educational, promotional or reporting purposes.
